"THE HALSWELL COUNTY COUNCIL acting on behalf of The Chairman, Councillors and Inhabitants of the County of Halswell and in pursuance and exercise of the powers conferred on it by The Counties Act 1956 and any amendments thereto and all other powers and authorities It in any way enabling hereby by special order makes and ordains the foUowing by-law: SHORT TITLE: The Short Title of this by-law shall be "The Halswell County Building (Garages) By Law 1964". 1. Definition: "Garage” means a building or land used for the housing or care of self propelled vehicles other than a building in which any self propelled vehicle not belonging to the occupier of the premises or his family is serviced, overhauled or repaired and includes any building other than a dwelling house. “Premises” means the land comprised in a separate certificate of title issued under The Land Transfer Act 1952. 2 No person shall erect any garage unless: (a) every part thereof shall be at least 19 feet away from any other building; and (b) every part thereof shall be at least 3 feet away from the boundaries of the premises. Provided that it may be built within the said distance of three feet if the wall nearest to the boundary is erected in permanent fire proof material with a parapet projecting not less than one foot six inches above the roof and (c) every part thereof shall be no nearer the road or roads bounding the premises than the wall of the dwelling erected or to be erected on the premises which is furthest away from such road or roads Provided that where the physical features of the premises are such that adherence to this requirement would create undue hardship or where the premises is a back section the Council may in its discretion modify this requirement; and (d) he complies in all other respects with the County by-laws relating to -buildings 3. No person shall erect any garage unless there is already erected on the premises a dwelling or the garage is erected at the same time as a dwelling.” A copy of the proposed by-law is deposited at the office of the Council and is open to the inspection of the public during office hours continuously from the date hereof to and inclusive of the 16th day of April 1964.
