WHOLESALE LICENCE

Reversal Of Decision (N.Z. Press Association) AUCKLAND, Dec. 11. A decision of the Licensing Control Commission granting a wholesale liquor licence in the Mount Wellington Licensing Trust was reversed by Mr Justice Perry in a reserved judgment today. His Honour directed that the licence be granted to the unsuccessful applicant, Neville Alfred Mitchell, as trustee of the company to be incorporated under the proposed name of N. A. Mitchell, Ltd. "I would not lightly disturb its (the commission’s) finding but am compelled to do so by the fact that I regard its decision for selection as being in conflict with its previous decision,” said the judgment. In a 30-page judgment His Honour finds that the commission reached its decision on incorrect grounds and on a wrong principle.
