ACCIDENT IN FOREST
Leave To Appeal Granted In a reserved decision given by the Supreme Court yesterday Mr Justice Macarthur granted leave, to bring an appeai out of time to Leonard Vernon Joseph Bielski, a forestry worker. In the hearing on October 24 Bielski’s counsel. Mr B. McClelland, said that he had suffered injuries to his back while moving a log with a crowbar as an employee of the New Zealand Forest Service.
In his judgment his Honour said that this was not a case where a seemingly trivial accident turned out later to have serious consequences, and Bielski could not claim that his failure to give adequate notice was due to a reasonable cause. However, said his Honour, there was no evidence that the Forest Service had been materially prejudiced in its defence by this failure to give the necessary notice. All the witnesses were still available.
Mr C. M. Roper appeared for the New Zealand Forest Service.
