The Napier City Council will appeal aigainst a recent Supreme Court decision by Mr Justice McGregor that the running of motels on Kennedy park, Napier, is il. legal. The council decided this with one dissenting vote from Cr. R. G. Baxter, who was in favour of accepting the Court's decision.
Local authorities had a distinct advantage over private enterprise because they paid no income tax on their business transactions, he said Proposing the appeal, the Mayor (Mr P. IWt) said that not only motels but also cabins or huts on public parks that were used for accommo-
dation and were not open to the public could be deemed illegal under the Court’s decision.
The Napier City Council sought to have amended legislation brought down during the recent session of Partiament to legalise the provision of motels on camping grounds, he said. “But the Government would not agree to amend the act and we have been advised to appeal against the decision of the Court.”
