Petition On Stewart-Dawson Estate

IN.Z Press Assn.—Copyright) SYDNEY, August 19 The estate of the late Stuar: Stewart-Dawson, formerly a managing director, of Bellvue Hill, an eastern suburb of Sydney, owed the Taxation Department £ 18,000, the Bankruptcy Court was told today. Stuart Stewart - Dawson died in August, 1961, aged 67. The Taxation Department has taken out a petition to have the estate administered .n bankruptcy. Mr C. B. Dillon, for the detriment. today asked Mr Justice Clyne to name the >erson on whom the petition should be served. It is due to be heard by the Court on September 9. Mr Dillon said the depart-

ment claimed the estate owed it £ 18,000—£7609 under a Supreme Court judgment of 1956, and £10,391 for income tax on Stewart-Dawson’s income in 1950-1959 inclusive. Stewart-Dawson made a will in June, 1953, in which he named his wife, Mrs Audrey Jean Stewart-Dawson, executrix and beneficiary, Mr Dillon said. Mrs Stewart-Dawson renounced her appointment as executrix in May, 1962, and died in June, 1962. Mr Dillon said StewartDawson had a son. David, by a previous marriage, but he could not say whether David was still living. He suggested the petition be served on the Union Trustee Company of Australia, Ltd., which held StewartDawson's will. The trustee company be-

lieved Stewart - Dawson’s estate was insolvent, and did not intend to apply for probate of the will. The company had asked to be approached by the Official Receiver “if and when the debts of the estate are paid in full." Mr Dillon said. Mr Justice Clyne: “You say the widow is dead and you don’t know whether the son is alive or not. "Yow ask that the petition be served on the trustee company, which is not Interested in the matter unless there is some money in the estate and they can get some commission. You will have to find out more about it." The Judge then adjourned the proceedings until Wed* nesday to enable the Com* monwealth Crown Solicitor's office to inquire about Stew* art-Dawson's son.
