Civil Appeal
Mr Justice Macarthur reserved his decision on an appeal by Milda Elizabeth Eade (Mr M. F. Hobbs) against a Magistrate’s decision in favour of a former tenant from whom she had claimed £7B 15s. She had claimed this amount from Allan Jackson <Mr R. K. Godfrey) for rent she said was still owing under an agreement to lease a garage at Prebbleton which Jackson vacated in September. 1962. Mr Hobbs submitted that the Magistrate was wrong in law if he based his decision on a conclusion that if the landlady had issued notices to quit, which he considered valid, then the lease was legally terminated. It was legally impossible to reach such a decision, he said.
