Magistrate’s Court BIGAMIST REMANDED FOR SENTENCE

Because she did not wish to give evidence in an assault charge against a man with whom she was living, Melva Irene Miller, aged 47, entered into a form of marriage with the man, Gordon Alexander Gillespie, when she was still married, said Senior-Sergeant G. M. Cleary in the Magistrate's Court yesterday. Miller pleaded guilty to a charge of committing bigamy. She was remanded on bail to July 29 for sentence by Mr A. P. Blair, S.M. The accused was represented by Mr M. J. Glue. Senior-Sergeant Cleary said the accused married Robert Douglas Miller in Wellington in 1932, when she was 16. They lived in Invercargill until 1947, when the accused left her husband because of domestic trouble. The accused worked in hotels in the South Island, being known as Miss Irene Miller. She then lived with Gillespie in the city, the pair being known as man and wife, Senior-Sergeant Cleary said. The accused laid a charge of assault against Gillespie earlier this year. Later, she said she did not wish to continue with the complaint, and was advised that if she married him she would not have to give evidence against him. The accused and Gillespie went through a form of marriage on March 17. When questioned by police she said she was aware she was still married at the time. Her reason for committing bigamy was that she was pressed to it, though she knew it was wrong, SeniorSergeant Cleary said. She had not seen her husband. Miller, for the last five years. Mr Glue said he trusted there was nothing implicit in the police summary that it was he who advised the accused to commit bigamy. He would deny such an implication strenuously. “I did not know until this charge that she had ever been married,” said Mr Glue. “At no stage did I say that Gillespie or the accused should get married. If the accused received such legal advice it was not from me,” said Mr Glue. The Magistrate: You are not on trial, Mr Glue. LICENCE CANCELLED A university student, Harold Wreford W. Hoyle, aged 20, was fined £8 on a charge of riding a motorcycle at a speed which might have been dangerous in Ferry road on May 8. His driving licence was cancelled for one year, with a special dispensation that he be permitted to drive to work and university lectures from Monday to Friday of each week. He pleaded guilty. Traffic Sergeant H. J. McMorran said the defendant was checked at 45 miles an hour for about one mile and a half along Ferry road. He crossed numerous T intersections and two through intersections. ASSAULT Douglas Barry Borton, aged 17, a workman, was fined £7 10s on a charge of assaulting Robert William Walker on July 22. He pleaded guilty. CHARGE DISMISSED A charge of driving without due care and attention in Normans road on April 3, against James Edwin Sunbeam was dismissed. Sunbeam pleaded not guilty and was represented by Mr R. K. Godfrey.
