Lords Reject Chief Enahoro’s Appeal

LONDON, May A The House of Loads' appeal committee yesterday rejected Chief Anthony Eronseie Enahoro’s latest bid to prevent bis deportation home to face trial o® changes Of treasonable felony. Chief Enahoro. a former West Nigerian Minister and a vice-president of the Action Group Party, has been accused of plotting with members of this party to overthrow the Nigerian Government bv force. Chief Enahoro had already left Nigeria when the charges were filed against him in the Lagoa High Court last November. He was arrested in Britain against an extradition warrant under the Fugitive Offenders Act Lord Parker, the Lord Chief Justice, commented: “Everybody seems to have leaned over backwards in his favour.” Chief Enahoro has been imprisoned in England since December 13, 1962.
His counsel. Mr Dingle Foot asked tor his release today under section seven of the Fugitive Offenders' Act of IM. This section provides that if a fugitive who has been committed to prison has not been sent out of the country within one month of his committal “a superior court may, unless sufficient cause is shown to the contrary, order his discharge from custody.” Mr Foot told the three Law Lords: "You cannot hold a fugitive a day longer than there is sufficient cause. Every day has to be accounted tor. and if it cannot be accounted for he must be released.” The three Law Lords— Lords Reid. Morris and Hodson—announced their decision after a five-minute adjournment.
