Magistrates Court CARELESS DRIVING CHARGE DISMISSED

A charge of driving without due care and attention, brought against Augustus Frederick Goddard, aged 43, a bar manager, was dismissed by Mr E. S. J. Crutchley, S.M., in the Magistrate’s Court yesterday. Goddard (Mr W. F. Brown) pleaded not guilty. Traffic Officer J. McMorran prosecuted. Trevor George Robertson said that about 9 p.m. on November 2 he was driving north on the Main North road, near Papanui. As he approached the intersection of Langdons road he noticed a car coming in the apposite direction pull out into the middle of the road to turn into Langdons road. The car turned right in front of him when he was almost in the middle of the intersection. He attempted to avoid the other car, but a collision occurred. To Mr Brown, the witness said that it was a dark night and raining at the time of the accident. His car had no warrant of fitness, and he was driving with defective lights which would be dim with the poor visibility.

Goddard said in evidence that the lights of the approaching car were so dim that he thought it was much more than 100 yards away. He thought he had plenty of time in which to turn.

The Magistrate said that Robertson’s evidence was not entirely reliable and the weak lights, combined with bad weather, seemed to be something of a trap. It was unsafe to enter a conviction. BURGLARY

Pleading guilty to breaking and entering premises at 16 Main North road on March 18, Ronald Fteith Ayres, aged 27, a workman, was convicted and remanded in custody to March 25 for sentence.

Sergeant A. McLellan said a man was seen breaking the glass of a door at the premises. The police were called arid Ayres was found nearby. He at first denied the offence, and then admitted he had broken the door intending to enter and steal property. Ayres said that although he broke the door the premises were not entered and nothing was stolen. REMANDED

Two men, whose names were suppressed, were remanded on bail to March 25 on a charge of theft as a servant on March 18. Horace Edward Wonnocott, aged 59, charged with obtaining credit by fraud at Ashburton on March 18, was remanded for one month to the Sunnyside Hospital for observation.

Edward Noel Toomey was remanded on bail to March 22 on a charge of committing a breach of probation at Invercargill on February 21.
