Magistrate’s Court Brakes Failed On Car During Driving Test

The brakes failed on a car in which a traffic officer was taking a driver for the hill section of a licence test in Dyers Pass road, and the ear stopped only when it ran into the gutter, said Chief Patrol Officer J. Brown in the Magistrate’s Court yesterday.

The owner of the car, James Malcolm McMillan, was fined £5 on a charge of operating a vehicle in a dangerous condition. Mr E. A. Lee, S.M.. was on the Bench. Traffic Officer L. Wilkinson, who was conducting the test, found that both the hand and foot brakes of the vehicle were nearly nonexistent. The driver being tested was a friend of the defendant, eaid Mr Brown. He said the traffic officer drove the car back to the City Council office in a low gear, and then took the car and the defendant to the testing station; “The car was rejected in a warrant of fitness test and described as being in a dangerous condition.” McMillan said he had lost his driver's licence and the car had been kept at home. A friend sought the loan of the car for the test, and he thought it would be all right.

"Although I am impressed by the defendant’s argument, I am not impressed by his lack of his observation during his six years driving on the road in that he was not aware it was a restricted area." said the Magistrate when he dismissed a charge against Eric Hampton Lange of exceeding 30 miles an hour in Cranford street.

Lange pleaded not guilty, and was represented by Mr G. S. Brockett. Traffic Officer B. A. Watson said he checked by microwave the defendant's car travelling 40 miles an hour on April 4 in Cranford street

In evidence Lange said he thought that for those travelling south the restricted area in Cranford street began at the city end of the extension. There was a 30-mile-an-hour sign at the northern end of Cranford street but he did not know it was there until he particularly looked for it after being stopped on April 4. The -ign was well to the side of the road and was partly obscured by a tree.

Tire Magistrate said there were several unsatisfactory aspects about the case.

Nutira said he saw a car driven by the defendant turn into Radley street from Ferry road at about 30 miles an hour at 1.45 p.m. on April 20 "The car heeled over when turning and went over the middle line of the road while crossing the Radley bridge.” When stopped, (he defendant said he had been foolish and was in a hurrv to get home for lunch, the witness said. Mr Blunt submitted that there was no evidence that the defendant did not have a clear view into Radley street, and that, seeing no traffic comine he had allowed the car to drift over the middle line.
