Award Of £453 As Damages
A motor-cyclist whose leg was broken in a collision with a car in Hereford street three years ago was awarded £BOO general damages and £559 9s 5d special damages by a Supreme Court jury yesterday. The jury reduced the amount by two-thirds because of its finding of contributory negligence by the motor-cyclist. The net award w-as £453 3s Id.
lan Laughton Prescott (Mr E. S. Bowie, with him Mr R. J. de Goldi) had claimed £l5OO general damages and £564 9s 5d special damages from Desmond William Port (Mr R. P. Thompson, with him Mr C. B. Atkinson). The claim arose from an accident at the intersection of Barbadoes street and Hereford street at 12.15 a.m. on January 3. 1959, between the plaintiff's motor-cycle and a, car driven by the defendant. The jury found Port negligent in failing to keep a proper look-out. and it found Preseott negligent in travelling at an excessive speed.
