Man On Charge Of Killing Brother

AUCKLAND, Nov. 27. Tupe Hone Heta, aged 38, a workman, was committed to the Supreme Court for trial by Mr R. M. Grant, S.M., in the Otahuhu Magistrate’s Court today on a charge of unlawfully killing his brother, Hare Hone Heta, aged 34, a workman, thereby committing manslaughter. Heta was represented by Mr P. Browne, who entered a plea of not guilty. Heta was allowed bail of £5O. Katerina Heta, widow of the deceased, said that her husband, who was drunk at the time, went into the kitchen where her daughters were having tea. One of the daughters, Piriote, was crying because her husband was hitting the girl. Witness said she asked the accused, her brother-in-law, to try to stop her husband hitting the child. She was frightened of her husband, and she knew if she intervened it would only make matters worse. The accused.went into the kitchen. The next thing she saw was her husband lying on the floor. The accused told her to call a doctor. Catherine Heta, aged 14. said her father came into the kitchen and asked Piriote her name. She refused
to answer. Her father kept asking Piriote questions. When Piriote started screaming, she asked the accused, who was in a bedroom, to stop her father. The accused tried to calm her father, and hit him with his left hand. Her father fell back on a chair, and then hit a towel rack. He collapsed across the kitchen table. Dr. F, J. Cairns, a pathologist, said that the cause of death was a haemorrhage over the brain. The injuries could be consistent with the. deceased striking his head on a towel rail. Analysis showed that at the time of death, he was under the influence of drink.
