Arbitration Court Decisions The Court of Arbitration has held that New Zealand Wallboards. Ltd., is not a party to the Canterbury and tyestland Plasterers’ Award It has also declined an application by the company to join New Zealand Wallboards. Ltd.. Opawa road. Christchurch. as a party to the N.Z Wallboards, Ltd.. Auckland and Lower Hutt Employees’ Award. The proceedings resulted from a dispute at the company’s Opawa factory last month. The following oral decision of the Court was delivered by Mr Justice Tyndall on Thursday:— “A special fixture was made to hear an action by the Inspector of Awards against New Zealand Wallboards. Ltd. for enforcement of the Canterbury and Westland Plasterers' Award, and at the same time to hear an application from the company to extend the N.Z. Wallboards Ltd., Auckland and Lower Hutt award to cover the operations of the company in the Canterbury industrial district. “In view of the unusual circumstances surrounding the request for a fixture, the Court has decided to give short oral decisions. “In the action for enforcement. the Court is not satisfied that the company is bound as a subsequent party by the Canterbury and Westland Plasterers' Award and therefore judgment must be entered for the defendant. “With regard to the application by the company, the Court, after hearing Mr R. N. Taylor for the applicant company, and considering evidence called by him has reached the decision that the application be declined. “The Court expressed the view that in the interests of both employer and workers a separate industrial agreement or award shov’d be negotiated as early as possible to cover the specialised operations of New Zealand Wallboards, Ltd., in the manufacture of gibraltar board in the Canterbury industrial district."
