Magistrate’s Court THEFT OF SIGN AT PORT ADMITTED

Stopped by police near No 4 wharf at Lyttelton early in the morning of January 31, after being observed carrying a sign on hi* back, Robert Barry Thurston, aged 24, a junior second engineer in the Port Pirie, admitted taking the sign from a shop, and said that he had taken it as a souvenir, said Sergeant V. F Townshend in the Magistrate’s Court yesterday. At the police station a salt and a pepper shaker and a glass ashtray were found in Thur*ton's possession, he said. Thurston (Mr N. M. Buchanan > pleaded guilty before Mr A. P. Blair, S.M„ to a charge of theft of a bottled drink sign, valued at £1 18s, and theft of the shakers and ashtray, of a total value of 4s, on January 31. He was discharged without conviction, and was ordered to pay £5 towards the cost of prosecution.

‘These acts seem to be out of character, and he appeared to be genuinely sorry for the trouble he had caused," said Sergeant Townshend. Mr Buchanan said that there was a practice of taking souvenirs. “Thurston knows it was wrong. This was his first attempt at this practice, and he was caught,” he said. In discharging Thurston without conviction, the Magistrate said that he did not think there was any criminal intent. INDECENT ASSAULTS Pleading guilty to two charges of indecent assault on a girl aged 12 years and 10 months, at Lauriston on December 19 and 21. Sydney Keith Aldridge, aged 38, a railway surfaceman, was remanded to February 9 for a probation officer’s report and sentence. Aldridge, who was represented by Mr J. F. Burn, was granted a renewal of bail. REMANDED Hugh McFarlane, aged 50. was remanded to February 6 on a charge of indecent assault on a male between September 1 and 30, 1960. Bail was allowed in his own recognisance of £5O, with a similar surety. CHARGE DISMISSED Saying that no pedestrian cared to join issue with motorists on right of way when on a pedestrian crossing, but in this case he accepted the defendant’s evidence that the woman pedestrian had waived her rights by gesturing the car onwards, the Magistrate dismissed a charge against Frank Gordon Pickering. a traveller, of failing to yield right of way at a pedestrian crossing in Dichfield street on October 21.

Pickering, who was represented by Mr R. J. de Goldi, pleaded not guilty. The Magistrate said, however, that the rule that the pedestrian has the right of way on a pedestrian crossing must be strictly enforced.
