LEAVE TO PROCEED OUT OF TIME
Decision On Motion Reserved While laying a carpet in a house at Papanui on April 4, 1957, George William Quigley was burned when an adhesive he was using caught alight, and as a result he spent several months in hospital, it was claimed in the Supreme Court yesterday. Before Mr Justice Richmond. Mr P. G. S. Penlington, for Quigley, sought leave to proceed with a damages claim against the suppliers and manufacturers of the adhesive. Counsel also sought an order joining the suppliers and manufacturers as third parties to the action. The defendant employers, G. F. Jeffreys and N. E. Fehsenfeld, were represented by Mr R. P. Thompson. The first-named third party was Carpet Mill Products (5.1.) Ltd. (Mr P. T. Mahon), which supplied the adhesive, and the second-named third party was Ados Chemical Company, Ltd., of Wellington (Mr I. L. McKay, of Wellington), the manufacturers of the adhesive. After legal submissions by Mr Penlington, Mr McKay, and Mr Thompson, his Honour reserved his decision on the motion to proceed out of time, and also that the third parties named should be joined as defendants.
