AERO CLUB’S CLAIM
£1902 Awarded By Jury (New Zealand Press Association) AUCKLAND, June 15. A jury in the Supreme Court at Auckland today awarded the Auckland Aero Club £1902 Ils 9d against the Attorney-General for replacement costs and damage to two club aircraft which collided at Mangere on August 3, 1958. This was two-thirds df the full claim of £2853 17s 7d. Mr Justice Shorland entered judgment accordingly. The plaintiff alleged that the collision was caused through the negligence of an air traffic controller employed by the Air Traffic Control Branch of the Air Department. The jury found that the control officer was negligent in failing to give a red light to the Cessna before the aircraft came into collision, and that the Cessna pilot was also negligent in failing to keep a proper lookout. Because of this the plaintiff should bear 33 1-3 per cent, of the total damage. [Tuesday’s evidence on page 19]
