TAX CHARGES FAIL

Six Informations Dismissed (New Zealand Press Association) WANGANUI, December 1. After the hearing of a defended tax case occupying more than four hours in the Wanganui Magistrate’s Court today, Mr B. S. Barry, S.M., dismissed all six charges of wilfully making false returns of income preferred against a Raetihi farmer, Neil Hendry Mitchlnson. The Magistrate also declined to take the alternative course open to him of amending the charges to ones of negligence in making returns, stating that he considered the defendant had satisfactorily explained discrepancies in his returns in connexion with certain sales. “I cannot see anything in the conduct of the defendant which would justify holding him guilty of making false returns,” the Magistrate added. The charges related to returns of income made for the period covering the years 1952 to 1957 inclusive.

Mitchinson was represented by Mr W. G. Clayton. The prosecution alleged a net deficiency in returns of £4136 9s over the six-year period, including £3234 in omitted sales. The department’s assessment of the defendant’s income during this period was £15,389, compared with actual returns furnished amounting to £11,219.
