£470 Compensation Awarded

Judgment for £470 was given in the Compensation Court yesterday by Judge Archer for a man who suffered back and hip injuries when he was struck by a fall of coal and caught against a winch in the Dobson State Mine.

Claiming that he had been wholly incapacitated by the accident James Christie McClure (Mr W. D. Taylor) sought compensation against the AttorneyGeneral (Mr C. M. Roper) for loss of wages. Mr Roper said there was little dispute about the medical evidence. Two of the witnesses considered McClure would make a full recovery and that he could return to light work. The plaintiff had been told he could do light work but there were no light jobs available to him, said Mr Taylor. The weight, of the evidence showed that for the next 12 months at least he would be incapable of doing a full job. As the result of the injury he had suffered a loss of earnings of £l7 a week and was unable to resume his job as a mine trucker. His Honour said he would give judgment for the plaintiff for the full amount due and a further 6 months at £5 a week.
