INDEMNITY OF WORKERS

(New Zealand Press Association) WELLINGTON. September 23. An Employees’ Indemnity Bill, providing protection for employees in cases of liability for injury or death was introduced and read a first time in the House of Representatives today. The Attorney-General (Mr Mason) said it was not proposed to proceed with the bill this session. It had been brought down so that its provision might be studied further. He said the bill arose from a case in the United Kingdom which drew attention to the extent to which employees could be held liable for negligent acts and omissions in the course of their employment, even in cases where the employer was covered by insurance.

The bill will bind the Crown, and its main provisions are: (1) That where any employee, by negligence, causes injury or death, and the employer is in any way liable, the employer shall have no right of action for damages or indemnity against the employee; and (2) the employer shall indemnify the employee against all liability for causing injury or death, provided the negligent act or omission was not attributable to serious and wilful misconduct of the employee.
