THURSDAY (Before Mr Rex. C. Abernethy,

S.M.) CHARGE DISMISSED

A charge of converting a motor, ear valued at £2OO against Joszef Szabo, aged 27 and Gustav Hegedus, aged 29, was dismissed. The prosecution alleged that the car was taken from Allard street about 2.30 pan. on New Year’s Day and later in the afternoon its owner, Frank Anthony Paviell, saw the two accused driving the car through Cathedral square. He followed the car and when it stopped in Cashel street be approached them and sought an explanation. Neither could speak English and a constable was told of the incident The two accused were then arrested.

In evidence Paviell said that early in the morning of the same day he had given both accused a lift in the car but he had given them no permission to use it.

The accused said in evidence that they, had helped an English boy to push the car out of a gutter in Allard street and he then offered to drive them to the city. All had a few drinks at a city hotel and the other boy offered them the use of the car. They realised it was Paviell's but the boy said it had been lent to him by the owner. They accepted his offer and it was when they were driving it that it was seen by PavielL

Dismissing the charge, the Magistrate said he would make no comment but would give the accused the benefit of the doubt. SHIP DESERTION

On a charge of deserting the overseas ship Athenic at Lyttelton on October 28. 1955, Derek Gordon. Hair, aged 23 (Mr R. G. Pen Un gt on) was convicted and fined £lO and was ordered to be detained pending deportation.

Mr J. G. Rutherford appeared for the shipping company. Mr Penlington gave notice of defendant's intention to apply, within seven days, for permission to stay in New Zealand. . Since he deserted he had been working steadily and appeared to be a good type. In reply to a question by the Magistrate counsel said the defendant was married but his wife Was in England and he was about to begin divorce proceedings. The Magistrate said he could not say whether the defendant would be allowed to stay in the country but he was entitled to make application which would be considered when it was made. Bail was refused. REMANDED Warren Martin, aged 30, a slaughterman, was remanded to January 29 on a charge of attempted rape. He has elected trial by jury. Bail of £lOO with one surety of £lOO, was renewed and the accused was ordered to report daily to the police. A 23-year-old man, whose name was ordered not to be published in the meantime. Was remanded to January 16 on a charge of obscene exposure in Bunyan street on January 5.

Bail was renewed. < A charge of committing an indecent act with intent to assault or offend on December 24. against lan Raymond Todd, was adjourned to January 16.
