Appeal Dismissed

John Bryan Elliot, aged 28 (Mr H. S. Thomas) appealed unsuccessfully in the Supreme Court yesterday against a sentence of corrective training imposed ini the Magistrate’s Court on December 7, 1956, on six charges of) breaking and entering and theft and one of breaking and entering with intent to commit theft. Mr. Thomas said that Elliot, who was above average intelligence, suffered from a mental trouble of an uncommon kind and it appeared that there was very little likelihood of his being cured in prison or outside. Counsel asked j his Honour to impose a definite; sentence as it seemed that cor-i rective training was not going to' solve Elliot’s difficulties.

Dismissing the appeal, Mr Justice Adams said there was no reasonable prospect of dealing with the appellant in any other way than incarceration. Elliot had not only psychopathic tendencies but was also a criminal of a dangerous type. . When he broke into the premises, he stole articles of considerable value and I did wanton criminal damage.
