NO MONOPOLY BY DU PONT’S

Cellophane Business

In America

(Rec. 10 p.m.) WASHINGTON. June 11.

The United States Supreme Court today rejected a Government complaint that E. I. du Pont de Nemours and Company illegally monopolised the cellophane business. Mr Justice Reed delivered the four-to-three decision. Chief Justice Warren wrote a dissenting opinion. The decision upheld a ruling by District Judge Paul Leahy in Wilmington, Delaware, clearing the company of creating and maintaining a monopoly. The Federal Justice Department insisted that the company had power to exclude cellophane competition and tc control prices, and had achieved that power “by use of means which were illegal and exclusionary.” Chief Justice Warren said the majority ruling virtually emasculated the anti-monopoly provision of the Sherman Anti-trust Act.

The Government’s civil anti-trust suit against du Pont was filed in 1947.
