FALSE PRETENCES CHARGES

Donaldson Tanihera Miller, aged 38. a truck-driver, appeared before Mr Justice Adams in the Supreme Court yesterday for sentence on two charges of false pretences on which he was released on probation by the Supreme Court on May 13, 1955. On M a Y of this year, Miller was sentenced in the Magistrate’s Court to six months’ imprisonment for theft and false pretences.

Miller was sentenced to 12 months’ imprisonment concurrent with the sentence he is at present serving. Miller told’ his Honour that in the

last three weeks he had managed to find his feet. When he-had finished his present term of imprisonment he would be all right. He had done a year of his probation, and before he was sentenced in May, 1955, he had been five months in prison.

I took the ns! of releasing you on probation for three years, Miller, and I warned you o the consequences if you committed ? breach of your probation or any further criminal offence. “The Court was acting with extreme leniency towards you, and it now seems that the leniency was misplaced. You have been recently convicted in the Magistrate’s Court on two charges of theft and one charge of false pretences. and this renders you liable to be sentenced anew on the original charges.” said his Honour. . Miller was- sentenced to nine months imprisonment on the charge relating to the truck and three months imprisonment on the charge relating to the money obtained Andrews, these sentences to be cumulative to each other, but concurrent, with the sentence imposed in the Magistrate s Court.
