FOX’S APPEAL DISMISSED

SENTENCE FOR SHOP BREAKING “The Press” Special Service WELLINGTON, December 11. In a reserved judgment, delivered by the Court of Appeal, the appeal of Clifford Fox, a carpenter, aged 33, against a sentence of preventive detention for breaking and entering the premises of Beath and Company, Ltd., New Brighton, and committing theft, was dismissed. Fox’s appeal against a sentence of two years’ imprisonment on a charge of escaping from lawful custody, to be served concurrently with the preventative detention, was upheld. The Court held that no good purpose would be served by putting the appellant on trial again on this count and the fairer course was to direct that an acquittal be entered. In the Court’s opinion the sentence of preventive detention was a proper one. The Court comprised Mr Justice Finlay, Mr Justice Gresson, Mr Justice Cook, Mr Justice North and Mr Justice Henry. Mr Justice Henry read the judgment. Mr B. J. Drake (Christchurch) appeared for Fox and Sir William Cunningham represented the Crown. An appeal by Richard Stanley Wratten, carpenter and labourer, against his conviction on charges of breaking and entering with intent, and possessing at night, without lawful excuse, instruments of housebreaking, was dismissed.
