SubInspector F. J. Brady represented the police. It was alleged that negligent driving hy Chambers caused the death of a cyclist. Francis William Winters, on the Sumner road on May 28. Evidence was.given by Mervyn Stenhouse, who said he had seen a motorcycle and cycle lying on the Sumner Causeway about 11 p.m. on May 26 with two bodies nearby. The visibility was not good. Mr Hay said there was no evidence to show how the accident occurred, and there was a doubt whether the cycle was properly lighted. “It would be wrong and dangerous to convict Chambers on the evidence submitted,” said the Magistrate. “There is no evidence of neglect in a very unfortunate.accident,” he said.
