LOSS OF HAUITI
Magisterial Inquiry Upheld
FINDING ON FOXTON ALSO SUPPORTED

Supreme Court judgments on the Hauiti sinking and the Foxton stranding agree “in substance” with findings by Magisterial inquiries earlier this year. The rehearing had been ordered by the Minister of Marine. The Court, in its judgments today agreed “in substance” with the findings of Mr M. B. Scully and the assessors in the Magisterial inquiry into the Hauiti sinking. They had held that the master of the Hauiti (Captain P. E. Charles) had made an error of judgment but had not neglected his duty. The Court also agreed “in substance" with the findings of the Magisterial inquiry by Mr J. S. Hanna and assessors into the Foxton stranding. The Magisterial inquiry held that the casualty was not caused or contributed to by any wrongful act of the master (Captain S. A. Jones) nor by any wrongful act of the mate (Mr P. B. Page). There had been an error of judgment by the mate, said the Magisterial inquiry.
