MAGISTRATE’S COURT Clarence Albert Newman, a barman, aged 37, pleaded giiilty before Mr Rex C. Abernethy, S.M. in the Lyttelton Magistrates Court yesterday to a charge of attempting to drive a car while he was intoxicated. Senior-Sergeant J. L. Graham said that about 3 a.m. on August 5 a constable saw two men come out of the Royal Hotel and enter a rental .car. They seemed to have some difficulty with the car, and the constable turned back to offer his assistance. He saw Newman get out of the car, and that he was under the influence of liquor. Newman denied that he was the driver.

Mr J..G. Leggat, who appeared for Newman, said it was almost a borderline case. Newman, since he returned from active service, had been in poor health and unsteady. Counsel asked that leniency be extended to him. "Had you been driving at the time, I should have’ sent, you to gaol.” the Magistrate told Newman. He fined the defendant £l2 and ordered that his licence be suspended for 12 months. For failing to give way to a vehicle approaching from the right, John Septimus Illingworth was fined £l.
