CHARGE AGAINST BREWERY

CONVICTION UPHELD BY JUDGE (New Zealand Press Association) AUCKLAND. November 9.

The appeal by Dominion Breweries, Ltd., against conviction on a charge of committing a breach . under the amended Medical Advertisements Regulations was dismissed by Mr Justice Turner in a reserved judgment given in the Supreme Court at Auckland today. The company was prosecuted because an advertisement, it was alleged, suggested that Dominion Bitter beer had medicinal properties. The advertisement dealt with the case of a Mr Kelly, who was said to have been severely wounded in the shoulder in the First World War. It was said that Mr Kelly went down to 6st in weight, and was despondent, and almost hopeless. He was introduced to congenial friends and “good, wholesome Dominion Bitter.” His Honour said the matter would be remitted to Mr L. G. H. Sinclair, S.M., who heard the case in the Auckland Magistrate’s Court who would enter a conviction and decide the penalty.
