TYRES DAMAGED BY POTHOLES
MOTORIST AWARDED £l4 DAMAGES (New Zealand.. Press Association) WELLINGTON. November 9.
Finding that the Wellington City Corporation had failed in its statutory duty to keep the tram rails in good condition and repair, Mr J. B. Thomson, S.M., today awarded Lindsay Herbert Brown, a Petone engineer, £l4 for damage to his car tyres. Two tyres, the plaintiff claimed, had been torn by the tram rails at the Elizabeth street-Kent terrace junction after the wheels had run into a hole, 3ft or 4ft long, 6in to Bin wide, and several inches deep. In the Magistrate’s Court today Brown was awarded the full amount of his claim against the corporation. The case was heard on August 4, but judgment had been withheld pending a decision of the Supreme Court in an Auckland case.
The Magistrate said, however, that both counsel agreed that that decision had no bearing on the present problem.
