POWERS OF COURT SET OUT (New Zealand Press Association)

WELLINGTON, May 12. The Economic Stabilisation Regulations, 1953, which were gazetted last night, provide that the Arbitration Court may from time to time, of its own motion or on the application of any industrial union or industrial association of employers or workers, make a general order amending the provisions of all awards and industrial agreements as to rates of remuneration of workers to the intent that those rates shall be increased or reduced as the Court thinks just and equitable. The Court is not to issue a new general order to take effect within six months of a previous one becoming effective. , In making general order, the Court shall take into account: (a) Any rise or fall in retail prices as indicated by any index published by the Government Statistician. (b) The econontic conditions affecting finance, trade, and industry in New Zealand. (c) Any increase or decrease in the volume and value of production in the primary and secondary industries of New Zealand. (d) Relative movements in the incomes qf different sections of the community. (e) All other considerations that the Court deems relevant. Before making any general order the Court shall afford representatives of the parties bound by awards and industrial agreements or by orders of tribunals an opportunity to be heard. Failure of any parties to appoint such a - representative shall not invalidate any general order of the Court. Every general order made under the regulations shall be deemed to be incorporated in every award and industrial agreement then in force, either from the date of the general order or from such later date as may be specified in the general order. The Court may, by any general order or a subsequent order, of its own motion or on application made not later than 28 days after the date of the general order by any party to an award or industrial agreement, make such provision as it considers just and equitable for any class or section of workers if it is satisfied that by reason of the special provisions of any awards or industrial agreements affecting those workers, or of economic and financial conditions* affecting any trade or industry, or of any other relevant consideration, that class or aection of workers should be excluded from the operation of the general order. Awards far Excluded Workers Where the Court has of its own motion excluded any class or section of workers from a general order, it may subsequently, on application made within 28 days by any party to an award or industrial agreement, make such award applying to that section or class of workers as the Court considers just and equitable. Every application under this regulation shall state the special grounds on which the application is based. In making any general order, the Court may exclude from the scope of the order such portion of the remuneration in each week of the workers affected by the order as exceeds an amount determined by the Court. The Court may vary this amount for’ female workers and juniors. In making any general order, the Court is *to exclude all allowances for tools, bicycles, motor vehicles, protective or special clothing, or special footwear. The regulations provide that the Court may, to give effect to the standard wage pronouncement it made on July 12, 1952, amend existing awards or industrial agreements in respect of rates of remuneration. In doing so, the Court is to have regard to any increases granted by the Court or agreed to by the parties to the award or agreement since the date of the last preceding wage pronouncement made by the Court Where the Court has, of its own motion, made such an amehdment, it may consider within 28 days of the amendment any application from affected parties for further or other amendment applying to any class of workers. Such applications must state the special grounds on which the application is based.
