MAGISTRATE’S COURT

TUESDAY (Before Air Rex C. Abernethy, S.M.) FINE FOR DRUNKENNESS Herbert Joseph Young, a seaman and cook, aged 39, pleaded guilty to a charge of being found drunk in Manchester street on Monday evening, having been twice convicted of similar offences in the last six months. He was convicted and fined £3, in default seven days’ imprisonment. The defendant also pleaded guilty to charges of wilfully damaging a window valued at £2, the property of Robert John Leslie Cole, and of procuring liquor during the currency of a prohibition order. He das convicted and ordered to make restitution ol the amount of the damage on the first of these charges, and ordered to pay costs on the second. Senior-Sergeant J. C. Fletcher said the defehdant had broken a window for no apparent reason in the hotel where he was staying. He had been drinking at the time, and did not remember much of what had happened. The Magistrate told the defendant that he was heading for Roto Roa Island if he did not decide to leave the drink alone. The defendant asked for time in which to pay, but this was refused. CLAIM FOR DAMAGES The Magistrate reserved his decision on a claim by Oswald Anderson, a storeman clerk (Mr P. T, Mahon) for £309 12s 6d damages from Hugh Campbell Steel, licensee of the Star and Garter Hotel (Mr C. S. Thomas). The claim was for injuries to a hand which Anderson suffered on December 18, 1950, when he slipped in some beer on a linoleum floor while employed as a casual barman. Anderson .said he had been walking across the foyer of the hotel from the lounge after collecting some empty glasses. He slipped in a pool of beer and fell to the floor. Some of the glasses broke and severely cut his right hand. Stitches were put into the hand, and he had massage treatment. This was not successful, and two months later his little finger was amputated. He was unable to grip things properly with the hand. The defendant said he used a polish on the floor of the foyer which was generally recognised as less slippery than most. He had seen a small pool of beer on the floor after Anderson’s fall, but thought it likely that it had come from the glasses he had been carrying.
