WRIT OF ATTACHMENT ISSUED

Although the defendant had been evicted from a house in Garden road on February 3, he had re-entered the property the same evening and was still there, said Mr P. T. Mahon, when he appeared before Mr Justice Northcroft in the Supreme Court yesterday in support of a notice of motion brought by Charlotte Maude Herne for leave to issue a writ of attachment against Herbert William George Herne (Mr B. McClelland). Mr Mahon said an order for possession of the house had been made against the defendant on October 27, 1952. He failed to leave the house in compliance with the order, and a writ of possession was issued on him. On February 3 the Sheriff’s officer evicted the defendant from the property, but that night he came back. He was still there, and he said he would not go. His re-entry after being evicted was contempt of Court, and therefore an application for a writ of attachment l:ad been brought. No instructions had been received from his client said Mr McClelland. He conceded that his client had been guilty of contempt of Court. His Honour granted leave to issue the writ of attachment, and directed that the defendant be brought before the Court next Wednesday.
