SECRET BALLOT BY MINERS
LEGAL OPINION ON VALIDITY
(New Zealand Press Association) DUNEDIN, April 12.
In a statement released to-night, Mr F. Crook, the national secretary of the United Mineworkers, said he had received an opinion from the union’s legal adviser on the rule dealing with secret ballots.
The opinion read as follows: “We have considered the rules of the United Mineworkers of New Zealand and in particular Rule 17, dealing with ballots.
“In our opinion there can be no doubt that the interpretation of this clause means a secret ballot. Apart from other arguments, the full history of the minutes of the United Mineworkers provides unassailable proof over numerous instances that the interpretation we referred to is undoubtedly correct. “In our opinion the recent ballot taken on March 28 is binding on all members of the United Mineworkers of New Zealand.” Mr Crooks said that this should be a sufficient answer to persons questioning the validity of the ballot, which favoured a return to normal work by the union’s members.
