LOTTERY PRIZE DISPUTE
HALFSHARp CLAIMED (P.A.) WELLINGTON, March 15. The hearing of a claim for a half share in a £4OOO prize in an overseas lottery, in which the plaintiff alleged he had a half share under a standing arrangement of sharing tickets, began in the Supreme Court to-day before Mr Justice Gresson. The plaintiff is Edward. Alexander Foreman, a theatre manager, of Lower Hutt, and the defendant is Ada Ann Jones, a confectioner, of Lower Hutt. Counsel for the plaintiff said that the claim was founded on joint ownership of an overseas lottery ticket. Foreman claimed that he was entitled to an equal share in the ticket and that the ticket, coming into the hands of Mrs Jones, was presented by her or her agents and that she received the whole of the proceeds and denied the plaintiff’s right to any portion. Charles Keith Carpenter said he was present when Mrs Jones was informed ot the result of the lottery. Just before she was told, somebody had said something to the effect that she was about to hear some very good news. Mrs Jones had: “Don’t tell me we’ve won a prize.” Mrs Jones, in evidence, said that before the Melbourne Cup lottery, she had not had dealings with Foreman over tickets. She had never agreed to their buying alternate tickets and sharing any prize. The hearing will be continued to-mor-row.
