MAGISTRATE’S COURT

FRIDAY. (Before Mr F. F. Reid. S.M.) REMANDED On a charge of being found intoxicated when in charge of a motor-car in Riccarton avenue on February’ 24, John Clarence Falloon. aged 49. was remanded to March 4. Bail was allowed in the sum of £2O. On a charge of being found on enclosed premises at 199 Marshland road. William George Whitley aged 20. was remanded to March 4. Bail was allowed in the gum of £ 10. INFORMATION DISMISSED William George Brown pleaded not guilty to a charge that on January 15 at Barotonga he secreted himself and went to sea on the s.s. Marabank without the consent of the master. Mr R- A. Young (who appeared for Brown on instructions from the Island Territories Department) said that when the ship was at Rarotonga it took aboard about 300 -unele men for Makatea a French possession. When the ship was at sea it was discovered that Brown was a married man. He then paid his fare ‘ to a member of the crew. The French authorities at Makatea, how- ! ever, refused to take Brown, who was put ' on board the ship, which then came to New Zealand. Brown had no option in the matter. Sub-Inspector G H L. Holt admitted that the evidence for the prosecution was very weak and the Magistrate dismissed the information. Mr Young said that Brown would be outfitted in Christchurch, taken to Wellington. and returned to Rarotonga on the first available ship. CHARGE WITHDRAWN Melvyn Evell Foster (Mr W. R Lascelles), aged 26, was charged with ’being absent without sufficient excuse from hi° Ship. Mr Lascelles said the master of the shin had fined Foster £□. and submitted that as the accused had been punished he doubted whether he should have been brought before the Court. The Magistrate said that the act did not apply, but referred to misconduct aboard ship. The accused was charged with being absent without leave, not misconduct. Sub-Inspector Holt agreed to withdraw the charge. INTOXICATED IN CHARGE John Douglas Grieg (Mr E. S. Bowie) was fined £4 and his driver's license was cancelled for 12 months on a charge of being found in a state of intoxication when in charge of a motor-car in Antigua street on February 24. TRAFFIC BREACHES Fines were imposed as follows for breaches of the traffic regulations in charges brought by the Police Department: — bicycle carelessly: Robert Blair, Attempting to cross a railway line when not clear: Gilbert Dalziel Buchanan ordered to pay costs. Failing to give way: Ronald Howard Crawford and Archibald Henderson Ross each £2: William John Taylor, 30s (no driver’s licence, costs only). Negligent driving: Keith Fitzsimmons, £5. Riding motor-cycle without due care and attention: Alister Miller, £2. No warrant of fitness: Albert Leslie Powell. 15s. Exceeding speed limit: Hardross Ernest Rudkin, £4 (jio warrant of fitness, costs only).
