MAGISTRATE'S COURT

THURSDAY (Before Mr F. F. Reid, S.M.) REMANDED Arthur Claude Just, a plasterer, aged 30, was remanded to appear on November 1 on a charge of breaking and entering by day the dwelling house of Rose Gladys Gasson, 101 Brougham street, and committing th>eft. He was remanded also on a charge of committing a breach of probation. CONVERSION OF BICYCLE Cyril Benjamin Goslin, a fish curer, aged 27, was sentenced to 14 days’ imprisonment with hard labour for converting to his own use a bicycle valued at £3, the property of a person or persons unknown. Sub-Inspector G. H. Holt said that Goslin had missed his bus home on the previous evening and had gone to the police station* and suggested that the police lend him a bicycle to ride to Harewood. The police had said they could not do that. Accused had gone down the road and picked up a bicycle from a stand. "This is just about as impudent a piece of conversion as I’ve heard of for some time,” said the Magistrate, in passing sentence. DESERTION Julian Smith, a seaman, aged 19, was sentenced to one month’s. imprisonment with hard labour for deserting from the Raranga at Lyttelton. CHIMNEY FIRE Ivanhoe Francis Cottam was fined 10s for allowing a chimney to catch fire. ON LICENSED PREMISES George Hughes and Arnold Leslie Sarchett were each fined 20s for beiYig on the licensed premises of the Woolston Hotel after hours. CHARGE OF ASSAULT Stanley George Frame, aged 47 (Mr R. A. Young) was fined £3 for assaulting Margaret May Frame. LIQUOR NEAR DANCE HALL Leslie Lancaster was fined £2 for having liquor near a dance hall. James Irving was convicted and fined £2 on a charge of being found in possession of liquor near a dance hall. CHARGES AGAINST THREE MEN. John Patrick Ellis, a machinist, and Neil Houghton, a labourer, both charged with disorderly behaviour, and Maurice George Costello, a fireman, charged with assaulting William Alexander Robb, were all convicted and ordered to pay costs, and each was ordered to pay £5 towards witnesses’ expenses. Sub-Inspector Holt said that at 6.35 p.m. on August 25 the three accused were walking along Gloucester street. They passed Robb and another man and made some insulting remarks. They were asked for an explanation, and Costello assaulted Robb without provocation. Robb fell and broke a window in a cafe. Some Air Force men in the cafe tried to stop the fight. The damage to the window amounted to £3O. For quite a while there had been a chance of a major riot in the street. The accuseds’ trouble appeared to be liquor. CYCLING ON FOOTPATH Charged with cycling on a footpath, Gordon Walter Mountford, aged 29 (Mr D. H. Godfrey), was convicted and fined 10s. A second charge—of offensive behaviour—was partly heard, and evidence given that accused had followed a woman along the footpath while on his bicycle. The hearing was adjourned until April 29, when a medical report will be produced. BREAKING AND ENTERING Bruce Watts Harding, a driver, aged 23, was committed to the Supreme Court for sentence on three charges to which he pleaded guilty. He was represented by Mr B. McClelland. The charges were that on November 8, 1947, he broke and entered the dwelling house of Leonard Wootton and stole clothing and jewellery valued at about £220; that on December 20, 1947, he broke and entered the warehouse of Brown and Armiger, Ltd . and stole a quantity of clothing valued at £32; and that on December 30, 1947, he received a radio valued at £2O 10s from Aparahama Kipa, knowing it to have been obtained dishonestly.

ATTEMPTED RAPE Brian Patrick Michael Joseph Ward, a hospital porter, aged 25, was charged with assault with intent to commit rape at. Hanmer Springs on October 16, and with the theft of a rifle, ammunition, a skinning knife, and a jacket, of a total value of £l2, the property of Robert John Young. The Magistrate ordered that the name of the principal witness in the first charge should not be published. Ward pleaded guilty to each charge and was committed to the Supreme Court for sentence. CIVIL CASES (Before Mr Rex C. Abernethy, S.M.) JUDGMENT BY DEFAULT Judgment by default was given the plaintiffs in the following cases:—Hutchinson Motors, Ltd. v. R. JUDGMENT SUMMONS C. H. Prince was ordered to pay J. H. Lowden £6 3s> forthwith in default seven days’ imprisonment.
