HUSBAND OPPOSES PETITION
RESTITUTION OF CONJUGAL RIGHTS SOUGHT
The hearing of a petition by Margaret Mary Wallace for an order for restitution of conjugal rights against Alfred Baptist Wallace, a barman, of Christchurch, was begun in the Supreme Court yesterday, before Mr Justice Fleming, and will be continued to-day. The petition is being defended by the respondent on two grounds. He alleges that the petitioner was intemperate and, while under the influence of liquor, was violent, abusive, and a source of danger to the person and property of the respondent; this amounting to cruelty. It is further alleged that there was an oral agreement to separate. Mr D. J. Hewitt is appearing for the petitioner* and Mr P. H. T. Alpers for the respondent. The petitioner, in evidence, said her husband left her on July 13, 1947, and refused to return The respondent, in evidence, gave detail? of occasions on which he said his wife had been violent towards him. Several witnesses cave corroborative vidence. Two witnesse.- nac eheo evidence on behalf of the petitioner when the Court adjourned until to-day.
