FIRM’S CLAIM FOR PAYMENT • _ From Our Own Reporter WAIMATE, Sept. 22. In a civil case which occupied the greater part of the day, when Mr E. ,A. Lee. S.M., was on the Bench at a sitting of the Magistrate’s Court at Wainiate, C. F. Cotter, Ltd., electrical contractors, of Christchurch, claimed the sum of £239 4s Id from Newall and Jones, Ltd., bakers, Waimate, the balance of payment on work done in the defendant firm’s premises in December and January. In a counterclaim, Nexyall and Jones claimed £39 8s 3d. Judgment for the plaintiff was given by Mr E. A. Lee, S.M., for £175 3s Id on the first claim. Newall and Jones,

Ltd., were ordered to pay costs. On the counter-claim, defendants were ordered to pay costs.

Newall and Jones (Mr G. R. Watters) alleged that they had been overcharged on the cost of the electrical work, • that the workmanship was defective, and the number of hours worked was excessive.

Watts said that the difficulties of obtaining labour and materials had justified the sum of the account, which totalled more than £5OO, of which about half already had been paid. ' In giving his decision, the Magistrate said that he viewed with suspicion the fact that the defendants had not complained about the rate of work being done in their premises, but the plaintifi did not show the standard of workmanship expected of a firm of such standing nor the speed they should have in finishing the job.
