MOTOR TEST CASE
CHARGE AGAINST WOMAN DISMISSED
(P.A.) WELLINGTON, October 1. A charge of driving without due care and attention, brought by the Lower Hutt City Council against Mrs Rita May Jackson as a test case to secure a legal clarification of the word “driving,” was dismissed in a reserved decision. , t The defendant was alleged to have parked her car on a slight slope without applying the handbrake. As a result her car rolled on to a pedestrian crossing. The Magistrate said that the question before the Court was whether the defendant could be said to be driving a motor-car after her car had come to a standstill in a proper parking spot and the defendant had turned off the engine with the intention of leaving I the car stationary there. “I think it would be wrenching the Word ‘driving’ far beyond its normal sense to hold this was so.” he added.
