MAGISTRATE’S COURT

THURSDAY (Before Mr Raymond Ferner, S.M.) COMMON ASSAULT Pleading guilty to a charge of assaulting Joan Lillian Henry, Arthur John Henry, a process worker living at Harewood settlement, was ordered to come up for sentence if called upon within two months. Henry said he had had a quarrel with his wife and admitted striking her in the face. CYCLE DEALER FINED “You imperil the renewal of your licence by your failure to record these dealings,” said the Magistrate, when imposing a fine of £2 on each of two charges against Phillip Francis O’Shea. O’Shea, for whom Mr J. T. Watts appeared, pleaded guilty to thfe charges that being a second-hand dealer, he failed to enter purchases of two bicycles. Mr Watts said his client did not know how to record these transactions. THEFT ADMITTED Desmond Patrick Stevens, of 12 Angus street, Sydenham, was ordered to be placed on probation for 18 months, when he pleaded guilty to .a charge of stealing £2 10s in money from Cecil Francis. Senior-Detective F. J. Brady said that Stevens, who was a labourer, aged 19 years, had stolen the money from hTs brother-in-law, Francis, while on a visit to Francis’s house. Stevens said he had since paid the money back. NAME SUPPRESSED A man whose name was suppressed was convicted of the theft of a tricycle. He was ordered to appear in the Court next week. The Probation Officer (Mr W. H. Darby) was asked to make a report. Liquor near a dance hall: John Alexander Robertson, fined £3. CIVIL COURT (Before Mr F. F. Reid, S.M.) JUDGMENT FOR PLAINTIFF The trustees of the Star of Opawa Lodge, No. 30 Independent Order of Oddfellows of New Zealand (Mr J. N. McFarlane) claimed £4 14s 2d from G. Newman (Mr J. A. Kennedy). Mr McFarlane said that the plaintiffs had let the lodge hall to the defendant on October 23, 1946, for a wedding function at which damage had occurred. Giving judgment for the plaintiff, the Magistrate said that if any material damage were done to a hall while it was being hired, the owner was entitled to look to the licensee for payment. CLAIM FOR REPAIRS Herbert T. Miles, a newspaper runner (Mr R. A. Cuthbert) claimed £lO 8s as the cost of repairs to his motor-car from D. L. Snook, an engineer (Mr J. A. Kennedy). It was submitted that a collision in which the plaintiff's car had been damaged had been caused by the negligent driving of the defendant. Judgment was given for the plaintiff for the amount claimed.
