MAGISTRATE’S COURT

MONDAY (Before Mr Raymond Ferner, S.M.) ON ENCLOSED PREMISES Harry Charles Irwin, aged 61 years, pleaded not guilty to a charge of being found without lawful excuse on the enclosed premises of St. Paul’s Presbyterian Church, Cashel street, on January 19. Constable N. Rouse said that at 11 p.m. on Sunday he found accused lying on the floor of an outhouse on the premises of St. Paul’s Presbyterian Church in Cashel street. Accused, who had admitted going there to sleep, said he had authority to do so. Giving evidence, Irwin maintained that some years ago he had been given authority to use all the amenities of the church. In imposing a fine of 30s, the Magistrate warned accused that a further appearance in Court would make him a candidate for the island. COMMITTED FOR SENTENCE When Sidney George Gamble, aged 21 years, and Robert Bain Wyber, aged 22 years, were called to answer a charge of breaking and entering the dwelling-house of Leonard Charles Simmonds at Rakaia on December 28 and committing theft, Detective-Sergeant A. A. Herron said Gamble had absconded and a warrant for his arrest had been issued. The charge against Wyber, who was represented by Mr D. J. Hewitt, was heard. Leonard Charles Simmonds said he had left his residence at 7 p.m. on December 28, and when he returned at 11 p.m. he found that the back door had been forced open and three bedrooms ransacked. Articles missing from his house incltided a camera and jewellery of a total value of £3B 15s. Wyber pleaded guilty and was committed to the Supreme Court for sentence. Bail was allowed in the sum of £lOO, and one surety of £lOO. REMANDED William Albert Gray (Mr W. F. Tracy) pleaded not guilty to a charge of stealing tools of a total value of £5 ss, the property of Albert Johnston. On the application of Senior-Sergeant J. J. Kearns, Gray was remanded until Thursday.
