APPEALS AGAINST SERVICE

f BOARD’S DECISIONS NUMBER OF WITHDRAWALS Among the reserved decisions given yesterday by the Armed Forces Appeal Board were several on cases in which West Coast miners or their employers appealed against overseas service. A number of other appeals were withdrawn by leave of the board. Mr F. F. Reid, S.M., presided, and associated with him were Messrs A. H. McKane and G. M. Hall. Mr W. F. Tracy represented the Crown. of medical, grading. , Leonard Noel Sandrey, appeal by Mrs L. Sandrey, employer, on the ground of the public interest and undue hardship.—Adjourned sine die, because of medical grading. Eric William Heihe, student, appeal by Canterbury University College; on the ground of the public interest.— Dismissed, reservist not to be called up before Jtyiuary 1. Brian Raymond Cobum, on the ground of the public interest. —The appeal was stated to have been made by Stacey and Hawker,, employers, but a representative of the firm said that there had been no intention to appeal, arrangements having been made to replace the reservist, but apparently a mistake had been made, and the Director of National Service had lodged an appeal. The appeal way withdrawn. Alfred Carter, toolmaker, appeal also by Booth, Macdonald and Company, employers, and the Director of National Service, on the ground of public interest.—Adjourned sine die on the appeal of the director. Employers dismissed for want of jurisdiction.

Ronald Francis Forsythe, appeal by the Director of National Service on the ground of public interest.—The reservist is a porter, and eyylence was

given •by G; H. McLean, • District Traffic Manager, that the point had been, reached where it was necessary to maintain the safe running oftfhe railway service, to appeal for trained porters. There were 19 other porters in his area for whom appeals had been lodged.—lt was decided to adjourn the appeal until the others came before the board. . >

Charles Boyne Myhre, a company director, appeal by W. B. Myhre, employer, on the grounds of the public interest and undue hardship.—W. B. Myhre said that the three brothers were active managers of the firm. He himself had been called up and passed fit, and another brother was in the ballot this week and presumed fit. No appeal had been made by himself or would be by the other brother, but the company desired C. B. Myhre to remain, as he had the technical knowledge of the trade in all its departments.—Adjourning the case sine die on the ground of the public interest, Mr Reid said that the appellant company was engaged in work of national importance and the board took the view that in deciding to ask the reservist to stay while the others went on service, it. was doing the right thing.

Stuart Henry Suckling, an accountant, aged 29, on the ground of conscientious objection.—The appellant said that he had been associated with the Exclusive Brethren all his life. He was prepared to do non-combatant service.—The appeal was dismissed, subject to the reservist doing non-com-batant service only.
