Sentence to Stand—Declining to interfere with the sentence of three months’ imprisonment imposed by the Magistrate, Mr Justice Smith has dismissed the appeal of Henry Sefton Herbert, of Hawera. against his conviction for taking part in the activities of a subversive organisation, Jehovah’s Witnesses. The main ground of the appeal was that the regulation under which Herbert was convicted was ultra vires and void; but his Honour held that the regulation was plainly valid, and that the delegation of discretionary authority to the Attorney-General was expressly authorised.—P.A.
