CYCLIST STARTLED BY DOG
COURT AWARDS DAMAGES FOR INJURIES SUFFERED

HASTINGS. March 22.
“If any dog on any highway or any enclosed place rushes out, attacks, or startles any person, whereby the life or limb of any person is endangered, or any property injured or endangered, such dog may immediately be killed and the owner or keeper of such dog shall be liable to a fine not exceeding £5 for every such offence over and above the amount of any damage occasioned by such dog.” This section of the Dog Registration Act was quoted by Mr J. Miller, S.M., in a reserved decision in Hastings to-day, in a claim for £66 8s general and special damages resulting from injuries to a cyclist who was startled by a fox terrier and fell. Judgment for £65 9s 9d was given the plaintiff, T. A. Atkinson, of Havelock North, against J. D. Heenan, of Havelock North. The Magistrate, upholding the section, made the keeper of the dog absolutely liable. Costs of £8 11s were also allowed against the defendant.
