November S. “I will repeal what 1 said before, that I think these raii-car? should have a more efficient vrai ning device.” said Mr Raymond Ferner, S.M., in the Magistrate's Court at Greymouth to-day. in fining Albert Alexander Ironsides 10s and ordering him to pay costs for crossing the New River combined railway and traffic bridge when the line was not clear.
“Here is a ease where a man was evidently preoccupied by alterations and inequalities of a highway in front of him.” continued Mr Ferner. He ran into a position of danger. No doubt his duty to look for the railcar was prevented by the necessity for having a close regard for the condition of the highway. It was certain that he would not have run into the position he did had he heard the warning device of the rail-car. However, he was in Court and must be convicted.
