CLAIM ON ESTATE AT WAIMATE

DAUGHTER’S SERVICES AS NURSE MAGISTRATE RESERVES DECISION A claim for services given in nursing her father, William Beer, until his death, was brought in the Waimate Magistrate’s Court, on Tuesday, by Florence Mary Beer, against Donald Kennedy and Robert Sinclair, trustees in the estate of William Beer. The Magistrate, Mr H. Morgan, S.M., reserved his decision. For the plaintiff, Mr S. I. Fitch said that she was a qualified nurse, and had attended her father for five years and a half, until his death, as he wanted to go home from the hospital in which he had spent 16 weeks. Till then she had been practising her calling in Christchurch. The plaintiff’s father had told his wife that the plaintiff must be paid for nursing him, and she assumed that she was to be paid for her services. Mrs Beer had since died, however, and the statement could not be corroborated. The plaintiff’s brother had suggested that it would be fair If the estate were divided equally, and had tried to persuade the rest of the family to sign an agreement to that effect, but had failed. The plaintiff had received nothing but some small cheques, amounting altogether to not more than five pounds a year. The original claim had been for £614. but this had since been reduced to bring the case within the jurisdiction of the Court. Had the plaintiff not undertaken the duties of nursing her father, he would have had to remain in hospital, or engage another trained nurse, which would have cost more than the present claim. Dr. T. W. Wylie said in evidence that William Beer had required expert nursing attention, which the plaintiff had given with great credit to herself. Otherwise her father would not have been allowed to leave the hospital. Trained nurses were difficult to obtain at any time in Waimate. Frederick John Beer, brother of the plaintiff, said he had not asked his father to alter his will, as he did not think his father was in a condition fully to understand the nature of the request. For the trustees, Mr G. R. Watters’ said that the claim rested on the uncorroborated evidence of the plaintiff and there was not sufficient evidence to support it. The trustees did not wish to belittle her services. WAIMATE MAGISTRATE’S COURT Mr H. Morgan. S.M.. presided at the monthly sitting of the Waimate Magistrate’s Court on Tuesday afternoon. S. E. Willetts, who pleaded guilty to failing to maintain his proper position on the road when turning a corner, was fined £1 10s. Judgment by default for the balance of the amount claimed, £2 10s 6d. was given for plaintiff in the case George Wilce v. W. Boyd. On a judgment summons. F. Joyce was ordered to pay P. V. Stevens £2 6s before June 15, in default two days’ imprisonment. WAIMATE RUGBY SUBUNION REPRESENTATIVE GAMES DISCUSSED The season’s representative games and trial matches were briefly discussed at the last meeting of the management committee of the Waimate Rugby Sub-Union. Mr A. J. Mcßae presided. The secretary was instructed to write to the North Otago Union asking for a match, and suggestions on the most suitable date. The arranging of other fixtures and a Possibles v. Probables match was deferred until further advice was received from the South Canterbury Union. The members agreed that the affiliated clubs should be given every inducement and encouragement to enter teams in the South Canterbury Union’s seven-a-side tournament on June 9. It was reported that some of the clubs were showing a preference for a similar tournament to be held by the North Otago Union on the same day, but a resolution was passed that club delegates do all possible to persuade their clubs to support the parent body in Timaru, as it had supported a recent tournament at Waimate. The draw for Saturday was set down as follows: Senior Grade—Southern v. Old Boys. No. 2 ground, 3 p.m.; Makikihi v. Hulmai, at Makikihi, 3 p.m. Junior Grade—High School v. Old Boys, No. 1 ground, 1.30 p.m.; Huimai v Makikihi, at Makikihi, 1.30 p.m.; Southern a bye. Third Grade—Primary School v. Old Boys, No. 3 ground, 1.30 p.m.; High School A v. High School B, by special arrangement on Thursday. HOCKEY AT WAIMATE SCHOOL STICKS PRESENTED BY TOWN CLUBS To encourage hockey among the pupils. the Waimate Men’s and Women’s Hockey Clubs presented 20 sticks, enough to equip two teams, to the Waimate Primary School yesterday morning. Mr W. F George, for the clubs, handed the sticks over to the headmaster (Mr J. L. Menzies), and Miss A. Crichton, a teacher, who will be in charge of the game at the school Mr Menzies, in thanking the clubs for their gifts, said that the school did not play one game only, and hockey would have every encouragement Mr George said that there was every chance of a competition for school teams. A club was to be formed at Walhao Downs, and the Waimate Club would also endeavour to persuade school teams from Oamaru to arrange games with Waimate. HARRIER RACE WAIMATE TO TIMARU For the Waimate to Timaru road race to be held on Saturday, the Timaru Harrier Management Committee’s arrangements provide for the event to begin at 1.42 p.m. The race will be run as an inter-club handicap event with teams of 24 runners, each man running approximately five miles The race will start from the Waimate Post Office and wili finish at the Timaru Borough Council Building. The runners will carry a message of greeting from the Mayor of Waimate to the Mayor of Timaru. The following handicaps have been declared by Mr F. King:—Timaru A team, scratch; ,/est End, Imin 30sec; Presbyterian A, 4min; Anglican A, 5 min; Timaru B, Bmin 30sec; Anglican B, 15min; Presbyterian B, 15min; Anglican C, ISmin.
