MAGISTRATE'S COURT

MONDAY (Before Mr E. C. Levvey, S.M.) THEFT FROM SHOP Charles Porteous was charged with the theft on March 28 of a jar of sweets valued at 12s 6d, the property of Francis A. Frayle, and also with drunkenness. Senior-Sergeant Calwell said a complaint was received on Sn'-urday that a jar of sweets had been tolen from a confectionery shop in Sydenham. The police made enquiries and found accused drunk, with the sweets in his possession. On the first charge accused was convicted and ordered to come up for sentence if called upon within three months, and ordered to pay all expenses. On the second charge he was fined 10s, in default 24 hours' imprisonment. THEFT OF BICYCLE Charged with the theft of a bicycle valued at £4, a youth whose name was suppressed, pleaded guilty. He also admitted a further charge of stealing an electric battery lamp valued at 4s 6d, the property of some person unknown. Senior-Sergeant Calwell said the youth, who was an orphan, was in possession of a bicycle under the hirepurchase system, and had sold it to an acquaintance. He stole another bicycle and left it in place of the one he had recently sold, taking back his own machine. When interviewed by the police he had made a clean breast of the episode. In regard to the second charge he went to get his bicycle from a garage where he had left it, and while there; took the lamp from another machine. He was only 17J years of age, and the manager of an orphanage was willing to take him back an'd give him a home until he was able to find, work again. The magistrate said accused had aggravated the first offence by the theft of the lamp. Bicycle thieves were getting no consideration from the courts at present, but he would take the risk of letting him go back to the orphanage on condition that he pulled himself together. The youth was convicted and ordered to come up for sentence if called upon within two years, and to repay as directed by the manager of the orphanage the sum of £3 10s obtained from the sale of the bicycle. On the second charge he was convicted and discharged. ' ANOTHER CHANCE GIVEN Pleading guilty to the theft on March 26, of an overcoat and scarf valued at £4 Is, the property of Kenneth J. Murray, John Buller McKenzie was admitted to probation for 12 months. Chief-Detective C. H. Dunlop said the theft was a contemptible one. Ac- ( cused had been lent the overcoat on

condition that he returned it next morning, but had sold it to a secondhand dealer for 7s 6d. Accused said he would get work in the country if given another chance, and would make full restitution. He said he was very drunk when he committed the offence. The magistrate agreed to give accused mother opportunity. He was ordered to make restitution of 7s 6d within 30 days, and to take out a prohibition older. A second charge, of breach of a maintenance order, was adjourned for two months, to be brought or. at seven days' notice if some effort at payment of arrears totalling £l6 8s was not made. REMANDED Edward Marshall and Arthur James Sharp were charged with breaking and entering the shop of David Mclntyre at Southbridge on March 25, and committing theft. On the application of Chief-Detec-tive Dunlop they were remanded tin April 7. YOUTH PROHIBITED Charged with drunkenness, Albert Stanley Penney, aged 19 years, was fined 20s. in default 48 hours'' idprisonment, and the magistrate gave instructions that a prohibition order should be applied for. TRAFFIC CASES Penalties for breaches of traffic regulations were imposed (and payment of costs ordered) as follows: No endorsed certificate for lorry: Arthur Bsylis. costs only; Langtry Maginness, 20. Cycling on footpath: Walter Butterfield, costs only. Overloading: Frederick Button, 20s. Unlicensed heavy traffic: Geoffrey M. Dixon £2; Alfred J. Clements, 20s. Unlicensed goods service: Edward Haines, £5. Cycling without a light: Allen Edward Kilman (voluntary appearance), 10s. Driving without a license: R. R. Biggs (voluntary appearance), ss; Clifford Hcrris, 10s. Riding motor-cycle without lights: Harold William Burleigh, 10s. Riding motor-cycle without lights and having no license: Robert Sinclair, £2 (first charge), and 20s (second charge). Unregistered motor-cycle and no license: James Wright, £3 (first charge), 10s (second charge). Having only one headlight: Colin D. Henderson, 20s. Speeding. Dudley Alvin Heybourn, £5; Henry Spencer, £2. A charge of parking in a prohibited area against William John Service was dismissed, and the defendant was ordered to'pay costs. - *"'''' ■
