, FRIDAY j -Before Mr E. D. Mosley, S.M.i BY-LAW CASES The following were dealt with on by-law charges:— Driving motor-car at dangerous speed: Archibald David Boyle, fined 20s and costs. Cycling on footpath: Ernest Burgess, 15s and costs: Frederick Craggs, 10s and costs: John Edward Gagliardi, 15s and costs. Cycling without a light: Cecil Arthur Burnett, 15s and costs; William Joseph Lamberton. 15s and costs; Frederick John Smith. 15s and costs; George Watts, 15s and costs; Reginald Stewart, 15s and costs. Motor-truck, insufficient lights: Louis Yick Shong, 5s and costs; Andrew Ngatiki Phillips, 5s and costs (motorcar). Failing to give way: Harold Moseley, 20s and costs; Joseph Douglas Thackwell, 20s and costs. Motor-lorry, no tail light: Pendlc Francis Gifkins, 5s and costs. VOLUNTARY APPEARANCES I The following appeared voluntarily: Bicycles without lights: William Ernest Cottier, fined 15s and costs; Bert Eastmond, 15s and costs; Leslie Burrows. 15s and costs. Motor-car not showing required lights: Arthur Wilson, 5s and costs; George John Morrow, 15s and costs; Matthew T. Dixon, 5s and costs; Keith Yarrall (motor-cycle), 5s and costs. Failing to give way at an intersection: William James Farrington, 10s and costs, and fined 10s and costs for driving without a license. CYCLING IN GARDENS Charged with cycling within the limits of the Christchurch Botanic Gardens. Henry Walter Anderson was convicted and fined ss. A caretaker at the gardens said, in evidence, that Anderson rode into the gardens through the main gate in RolIcston avenue, and went along the path for about five chains. Witness went to the cyclist and asked him to remove liis bicycle from the gardens. Anderson refused, saying that he intended to see the gardens, and mentioned something about being a ratepayer for many years. Witness then reported Iho incident to the curator.

The curator of the gardens (Mr J. A. McPherson) said that he secured the assistance of a police constable and a ranger, and found Anderson in the Hagley Park cricket ground. Witness said that it was the only case in 12 months in which a cyclist had refused to take his bicycle from the gardens. Generally the public was very good about the matter.

It was stated that notices prohibiting the taking of bicycles into the gardens were placed at each gate, with coiiies of the by-laws of the Christchurch Domains Board. Anderson said that he had left the gardens as soon as he was told. Mr Mosley mentioned that the case was really brought to emphasise the prohibition of bicycles in the gardens. He would treat the defendant leniently and fine him ss, without costs. NEGLIGENT DRIVING On n charge of negligently driving a motor-van. Otto George Hahn was ronvicted and fined £5 and costs, and for driving without a license he was fined 10s and costs. A charge of being in a state of intoxication while in charge of a motorv;n. against Hahn, was dismissed, Mr Mosley stating that there was a slight doubt, of which accused ought to have the benefit. Frederick Oddy Hobson, who was riding in the van when it collided with a cyclist in the city, and who owned the vehicle, was stated b/ Mr Mosley to be legally liable if he assumed the responsibility of letting Hahn drive, and on a charge of negligent driving he was convicted and
