PROSECUTION OF MAGISTRATE

I DUNEDIN, February 8. i An almost unique case of a private prosecution of a magistrate for a breach of the motoring regulations was heard in the s Court this morning, when, beforo Justices of the Peace John Frederick Hammerly alleged foul- such breaches against Henry William Bundle, S.M., all arising from an alleged turning before an intersection. Hammerly. who conducted the case in a way that drew a rebuke from Mr Callan, who represented the defendant, had called as a witness Mr J. R. Bartholomew. S.M., who, upon taking the stand, said; "I suggest that it is an abuse of the processes of the court that I am brought here. I know nothing of the case, and I was hundreds of miles away at the time.'' The bench concurred, Mr Bartholomew retiring. Hammerly, in addressing the court, concluded: "I appeal to God tor mercy. If I don't get it in this court, I'll go to another." Then, when the informations were dismissed, lie said that, he would appeal to the Supreme Court.
