A WRIT OF ARREST.
ACTION FOB DAMAGES FAILS. (Fssaa Assoamo* rnvgauit.) . . WELLINGTON, September 9. In the Supreme .Court ease is which Jack Anrndel Pearce, insurance agent, claimed damages from Dominion. Motors totalling £584, alleging that the defendant company, without reasonable and probable cause, instituted, an application for a writ of arrest upon him Mr Justice Ostler 'gave judgpient for the defendant company, with costs. The case arose atr a result of a writ served by the company on plaintiff In respect of a car purchased , under a hire-pur-chase agreement, the writ being served as plaintiff and his wife were leaving for Australia. His Honour said he was satisfied that plaintiff and his wife were quite honest people, and they had no. intention' of taking the ear out of New Sgealand with the object of evading payment. He held, however, that the defendant company had not acted maliciously is serving the writ, and had reasonable grounds -' for the action it had taken. His Ho'noui r held that the p&cond. cause of action (the alleged abuse of the processes gtf the Court) must fail also. -
